The conviction was expected. Scopes was a test case intended to challenge the law's constitutionality.

Unfortunately, the Tennessee Supreme Court found a technicality with the setting of the penalty that derailed the appeal.

I was pretty sure they expected to lose. Pity about the appeal, though.
